We are Roam Reality (“Roam”, “we”, “us”, “our”). Welcome! We’re excited for you to begin your journey with us, but before using Roam Reality, we need you to read, understand and agree to these Terms and Conditions.

We operate the mobile application Roam Reality (the “App”), as well as any other related products and services that refer or link to these Terms and Conditions. The App an augmented reality app which gives you, the User free digital navigation and insights to the best sites and attractions in a destination.
These Terms and Conditions constitute a legal agreement between you, the user (“you” or “your”) and Roam and govern your use of Roam’s app and services as described below. You agree that by accessing the Service, you have read, understood, and agreed to be bound by all the Terms and Conditions and policies referenced within, including our Privacy Policy and terms that limit our liability. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS AND CONDITIONS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND MUST DISCONTINUE USE IMMEDIATELY.
We will provide you with prior notice of any scheduled changes to the Terms and Conditions. The modified Terms and Conditions will become effective upon posting or notifying you by email whichever is earlier. By continuing to use the services after the effective date of any changes, you agree to be bound by the modified terms.
All users who are minors in the jurisdictions in which they reside (under 18 years) must have the permission of, and be directly supervised by, their parent or guardian to use the Services. If you are a minor, you must have your parent or guardian read and agree to these Terms and Conditions.
1. OUR SERVICES
The App is an augmented reality app which gives you, the User free digital navigation and insights to the best sites and attractions in a destination within whichever jurisdiction the app is utilized.
2. LICENSE
The App is licensed, not sold, to you for your use on your mobile device. You may not transfer or sub-license to any third party.
3. USER ACCOUNT
In order to use certain features of the App, you may be required to create a user account. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You must be ten (10) years and over to create an account and utilize the App. For Users under the age of majority (i.e. 18 years), parents and/or guardians are liable for minor users’ use of the App.
4. PAYMENT FOR SERVICES AND LIABILITY
From time to time while using the App, you will have the chance to purchase items to enhance your use and experience of the App. By using the App, you consent to the collection and use of your banking information as outlined in the Privacy Policy. Our services allow you to make payment to us. As a User you are responsible for the accuracy of the banking information provided by you.
Liabilities
You are solely liable for errors you make while using the App; this includes but is not limited to
- inaccuracy of information provided
- error is number of times a purchase is made (duplicate purchases)
- purchases of the wrong item (mistake)
- you change your mind about making a purchase
5. PRIVACY
The App may collect and use personal information/data as described in the Roam Privacy Policy. By using the App, you consent to the collection and use of your personal information as outlined in the Privacy Policy.
6. INTELLECTUAL PROPERTY
The App and its content, including but not limited to augmented reality overlays, graphics, logos, and images, are the property of Roam Reality and are protected by copyright and other intellectual property laws. Any content generated on the App remains the property of Roam Reality even when shared to other social media platforms. You may not modify, reproduce, distribute, or create derivative works based on the App or its content without the express written permission of the app developer or us.
7. PROHIBITED ACTIVITIES
You agree not to use the App for any unlawful or unauthorized purpose. You also agree not to engage in any activity that could damage, disable, or impair the App or interfere with any other party’s use and enjoyment of the App.
8. SAFETY AND RESPONSIBILITY
When using the App, you are solely responsible for your own safety and the safety of others. You should always be aware of your surroundings and use the App in a responsible manner. Parents and/or guardians should accompany minor Users.
9. LIMITATION OF LIABILITY
Roam Reality shall not be liable for any direct, indirect, incidental, special, or consequential loss or damage arising out of or in connection with the use of the App, even if the app developer has been advised of the possibility of damages.
10. INDEMNIFICATION
You agree to indemnify and hold harmless the app developer and Roam from any claims, damages, liabilities, and expenses arising out of your use of the App or any violation of these Terms and Conditions.
11. TERMINATION
We may terminate access to the App at any time without notice or liability. Upon termination, you must cease all use of the App and delete it from your mobile device.
12. GOVERNING LAW
These Terms and Conditions shall be governed and construed in accordance with the laws of Delaware, United States.
13. AMENDMENTS
We reserve the right to modify or amend these Terms and Conditions at any time. Any changes will be effective immediately upon posting the updated Terms and Conditions on the App.
14. SEVERABILITY
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
